Terms and conditions

General terms and conditions
  1. To purchase products on the site, you must be registered.
  2. Sales contracts by electronic means offered on this site are subject to compliance with current legislation in Chile. Especially consumer protection and personal data protection regulations.
  3. For all purposes related to contracts by electronic means offered by this site, the supplier and consumer establish their domicile in the commune of Santiago de Chile, to whose courts' jurisdiction they submit.
  4. Definitions:
  5. "Consumer" means the natural or legal person who buys goods or services through the electronic platform provided by this site.
  6. "Supplier" means the company GEOCOM S.A. which, through this website, offers goods and services to consumers.
  7. All prices of our products do not include VAT. The value-added tax will be reflected at the time of payment for the product.
  8. The mere visit to this website, in which certain goods and services are offered, does not impose any obligation on the consumer, unless the consumer has unequivocally accepted the conditions offered by the supplier, in the manner indicated in these terms and conditions.
  9. The unilateral right of withdrawal enshrined in article 3 bis letter b) of the consumer protection law is excluded from all contracts concluded by electronic means on this website, a fact that is known and accepted by the consumer. This exclusion cannot under any circumstances be interpreted as an exclusion of liability clause of the supplier for defects and/or flaws in the sold item, which will be governed by the legislation in force at the time of the conclusion of the contract.
  10. Contracts by electronic means offered on this site will be understood as concluded after the consumer accepts these terms and conditions and the supplier sends a written confirmation to the email address indicated by the consumer.
  11. In contracts offered through this site, the supplier will inform, unequivocally and easily accessible, the steps that the consumer must follow to conclude them, and will inform whether the electronic document in which the contract is formalized will be archived and whether it will be accessible to the consumer. The mere fact of completing all the steps indicated on this site for these purposes to make a purchase is equivalent to accepting that the offering company has effectively complied with the conditions contained in this numeral. In addition, the electronic contract will indicate the postal or email address of the supplier so that the consumer can identify and correct any errors in the shipment or in their data.
  12. Any acceptance of an offer will be subject to the suspensive condition that the offering company validates the transaction. Consequently, for every transaction made on this site, confirmation and/or validation or verification by the supplier will be a requirement for the formation of consent. To validate the transaction, the supplier must verify:
  13. That it has, at the time of acceptance of the offer, the items in stock.
  14. That it validates and accepts the payment method offered by the user.
  15. That the data registered by the customer on the site matches those provided when accepting their offer.
  16. To inform the user or consumer about this validation, the offering company supplier must send a written confirmation to the same email address that the user who accepted the offer registered and that is referred to in the previous paragraphs.
Buyer or Consumer Rights
  1. The consumer shall enjoy all the rights granted to him/her in these terms and conditions.
  2. Notwithstanding the foregoing, the consumer shall enjoy all the rights recognized by Chilean consumer protection legislation in force at the time of the conclusion of the contract, with the exception of the exclusions expressly contained in these terms and conditions.

When applicable, the consumer shall at all times have the right to information, rectification, and cancellation of personal data in accordance with Law No. 19,628 on the protection of personal data.

Payment methods accepted by the supplier

The products and services offered on this site, unless otherwise expressly stated for exceptional cases, can only be paid for using the following instruments:

  1. Visa, MasterCard, and Diners Club International bank cards issued in Chile or abroad, provided they maintain a valid contract for such purposes with the issuing company. Cards issued abroad do not support installment payments. The use of the aforementioned cards will be subject to these Terms and Conditions and, in relation to their issuer, to what is agreed upon in the respective Opening Contracts and Regulations of Use. In case of contradiction, the provisions of the latter document shall prevail.
  2. Debit bank cards. The use of the aforementioned cards will be subject to these Terms and Conditions and, in relation to their issuer, to what is agreed upon in the respective Opening Contracts and Regulations of Use. In case of contradiction, the provisions of the latter document shall prevail.
  3. Furthermore, concerning bank cards accepted on this site, aspects related to them, such as the issue date, expiration, credit limit, blocks, etc., will be governed by the respective Opening Contract and Regulations of Use, so the provider will not have any responsibility for any of the indicated aspects.
  4. The provider may, in each case, indicate specific purchase conditions depending on the payment method used by the user.
Change and Return Policy
  1. Notwithstanding that the provider excludes the possibility of unilateral withdrawal from contracts concluded by electronic means, the consumer may request returns or exchanges, within the territory of Chile, which "may" be accepted by the provider, in order to achieve full customer satisfaction. The parties state and accept that this is a right that is at the sole discretion of the provider. In any case, this request may only be made by the consumer within 10 business days from the receipt of the product.
  2. The requirements for any exchange or return are the following:

Send an email to ventas@geocom.cl and attach the proof of payment and state the problem. Subject: Exchange and Return Procedure.

  1. Request it within 3 months after the purchase of the product, in case of a defect or flaw in the product that renders it unsuitable for its natural use;
  2. The product must be unused, with tags, in perfect condition and must have its original packaging. You must deliver all its accessories, manuals and warranty policies, if they were included in the shipment of the product.
  3. Once the conditions established above are met, in the case of product exchange, it can only be done for the same product or one of equal or greater value, in which case, prior to the exchange, the price difference must be paid if applicable.
  4. In the events described above, shipping and product pickup costs in case of return will be borne by the customer. For security reasons, the customer may not make this shipment or pickup by their own means.
Dispatch of Contract Goods
  1. The goods acquired through this website will be subject to the dispatch and delivery conditions chosen by the consumer only within the options offered by the provider on the website for this purpose.
  2. All information related to the delivery location and name is the sole responsibility of the consumer.
  3. The chosen delivery and dispatch times are counted from when the offering company has validated the purchase order and the payment method used, and business days are considered for these purposes from Monday to Friday, excluding public holidays.
  4. The consumer may not use post office boxes as a shipping address, either in Chile or abroad.
  5. Product shipments from this site are only made within the territory of the Republic of Chile.

Privacy Policy

What do we do with your information?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, and email.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products, and other updates.

Consent

How do you obtain my consent?

When you provide us with your personal information to complete a transaction, verify your credit card, place an order, arrange a shipment, or make a return, we imply that you consent to our collecting and using it for that specific reason only.

If we ask for your personal information for a secondary reason, such as marketing, we will either ask you directly for your express consent or provide you with an opportunity to refuse.

How can I withdraw my consent?

If, after you have consented, you change your mind, you may withdraw your consent for us to contact you, or for the collection, use, or disclosure of your information, at any time by contacting us at ventas@geocom.cl

Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify's data storage, databases, and the general Shopify application. Your data is stored on a secure server behind a firewall.

Payment:


If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Third-party services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, some third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so that you can understand how your personal information will be handled.

In particular, remember that some providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you wish to proceed with a transaction that involves the services of a third-party provider, your information may be subject to the laws of the jurisdiction(s) in which the service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used to complete that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

When you click on links on our store, you may be redirected away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to ensure that it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

If you provide us with your credit card information, that information is encrypted using Secure Socket Layer (SSL) technology and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional industry-accepted standards.

Age of consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their publication on the website. If our store is acquired by or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
